Från Kongo/ UNHCR concerned by violence displacing thousands in North Kivu till sidans topp

UNHCR, the UN Refugee Agency, is deeply concerned about the urgent and large-scale needs of more than 72,000 people who have been displaced by fighting in recent days in North Kivu Province, eastern Democratic Republic of the Congo (DRC).

Since 19 May, intense fighting has shaken Rutshuru and Nyiragongo territories as militias claiming to be part of the M-23 armed group clash with government forces in a continuing struggle north of Goma, the provincial capital.

At least 170,000 civilians have been displaced, often repeatedly since an escalation of fighting in eastern DRC from November 2021. The latest wave of violence has driven tens of thousands of people from their homes in search of relative safety in different parts of the province, including Goma. Over the past week alone, some 7,000 have also reportedly crossed over to neighbouring Uganda - a country already hosting more than 1.5 million refugees.

Those on the move are exposed to constant violence. Fields and shops left abandoned are at high risk of being looted, threatening livelihoods. Women and girls are exposed to sexual violence, including rape, as well as physical threats and extortion by the warring parties. Numerous children have been separated from their families. The fighting comes just as communities previously displaced by insecurity in the region had tentatively begun to return home and re-establish their lives. This cycle of violence and displacement has become a repeated source of despair and danger.

Thousands of people displaced by the current clashes are facing difficulties in finding shelter and basic household items, as well as accessing food and clean water. Some count on the generosity of Congolese families, others have sought safety in schools, churches and sites built by the authorities for those forced to flee the Nyiragongo volcano eruption of May 2021.

Från Kongo/ Thousands flee into Uganda following clashes in DR Congo till sidans topp

UNHCR, the UN Refugee Agency, alongside the Government of Uganda and humanitarian partners, is assisting some 10,000 refugees in the country's southwest Kisoro district after they fled violent clashes in the Democratic Republic of the Congo (DRC) which began on 28 March 2022.

Thousands of children, women, and men have arrived from Rutchuru territory in the DRC, some 8 kilometres from the Bunagana border crossing in Uganda's Kisoro district.

In addition, nearly 36,000 people have been displaced within the DRC. Most are being accommodated by host families, or in markets and schools. Security conditions are making it difficult to reach those affected, but a taskforce led jointly by UNHCR and the World Food Programme is being established to organize the delivery of humanitarian assistance.

As people arrived in Uganda on 28 and 29 March, artillery fire and gunshots could be heard from across the border, indicating that clashes were ongoing. Six people arrived with gunshot wounds and were taken for treatment.

UNHCR and Uganda's Office of the Prime Minister - which manages several transit centres for asylum seekers along the Congolese border - are responding to the emergency in coordination with district and local authorities and our partners. UNHCR has already relocated some 2,350 asylum seekers to the nearby Nyakabande transit centre.

Heavy rains have made conditions even more difficult for people who arrived with only the few belongings they could carry. Currently, Uganda has closed the Bunagana border to trade but is thankfully allowing asylum seekers to enter the country. Other asylum-seekers are using irregular border crossings. We have also observed many unaccompanied children, older people and wheelchair users among those fleeing the violence.

Från Kongo/ Säkerhetssituationen i vissa delar av Demokratiska republiken Kongo till sidans topp

Migrationsverket har uppdaterat det rättsliga ställningstagande RS/016/2020.

Migrationsverket gör bedömningen att det i provinserna Nordkivu, Sydkivu och Ituri föreligger en inre väpnad konflikt och att den rådande situationen av urskillningslöst våld är så allvarlig att var och en som återvänder dit riskerar att utsättas för skyddsgrundande behandling enligt artikel 15 c i skyddsgrundsdirektivet. Kriterierna för alternativt skyddsbehov enligt 4 kap. 2 § första stycket första punkten andra ledet utlänningslagen är därför uppfyllda.

Migrationsverket gör bedömningen att säkerhetsläget i provinsen Tanganyika är sådant att inre väpnad konflikt enligt artikel 15 c i skyddsgrundsdirektivet föreligger. Säkerhetsläget varierar dock och en individuell prövning av den sökandes utsatthet ska göras i enlighet med Elgafajidomens kriterier (...)

I territorierna Ango i Bas-Uélé och Dungu i Haut-Uélé är säkerhetsläget sådant att det föreligger inre väpnad konflikt i den mening som avses i artikel 15 c i skyddsgrundsdirektivet och 4 kap. 2 § första stycket första punkten andra ledet utlänningslagen. Våldet som förekommer är emellertid inte urskillningslöst.

Migrationsverket gör bedömningen att det i provinserna Haut-Katanga, Lualaba, Haut-Lomami och Tshopo, i samtliga territorier utom Ango i Bas-Uélé, i samtliga territorier utom Dungu i Haut-Uélé inte råder inre väpnad konflikt enligt artikel 15 c i skyddsgrundsdirektivet och 4 kap. 2 § första stycket första punkten andra ledet utlänningslagen.

Migrationsverket gör bedömningen att rättsskyddet i Demokratiska Republiken Kongo (DRK) innehåller sådana brister att det inte går att hänvisa någon till staten för myndighetsskydd. (...)

Internflykt är som huvudregel inte relevant och rimligt i DRK.

Från Kongo/ Armed attacks kill hundreds, displace 40,000 civilians in northeast DRC till sidans topp

UNHCR, the UN Refugee Agency, is warning about an alarming increase in the number of attacks by an armed group on civilians in north-eastern parts of the Democratic Republic of Congo (DRC).

Since January, attacks blamed on the armed group, Allied Democratic Forces (ADF), have killed nearly 200 people, injured dozens of others, and displaced an estimated 40,000 people in DRC's Beni Territory in North Kivu province as well as nearby villages in Ituri province.

In less than three months, the ADF has allegedly raided 25 villages, set fire to dozens of houses, and kidnapped over 70 people. This is in addition to the 465 Congolese killed in attacks attributed to the ADF during 2020.

Attacks and widespread human right violations also continue in other parts of North Kivu province.

The main reasons for these attacks are reported to include retaliation by armed groups against military operations, their search for food and medicine, and accusations against communities of sharing information on ADF positions.

Those forcibly displaced this month have fled to Oicha, Beni and Butembo towns in Beni Territory, with many fleeing on motorbikes. The majority are women and children, as men stay behind to protect properties, exposing themselves to the risk of further attacks.

Displaced people are living in dire conditions without shelter, food, water or health care. In the context of Ebola and COVID-19, the lack of access to toilets, clean water, soap and menstrual hygiene products is of particular concern. In addition, families do not have enough essential items like blankets, sleeping mats or cooking materials.

Från Kongo/ EASO publishes a MedCOI report on the Democratic Republic of Congo till sidans topp

Today, the European Asylum Support Office (EASO) published a Medical Country of Origin Information (MedCOI) Report on the Democratic Republic of Congo (DRC).

MedCOI as a project was initiated to improve access to medical Country of Origin Information for national migration and asylum authorities in Europe. This project was transferred to EASO between 2017 and 2020, to become EASO business as usual as from 2021. While as under the MedCOI project, implemented by The Netherlands and Belgium, the Country of Origin Information reports on the health care situation were not publicly available, EASO intends to publish all MedCOI reports on the EASO COI Portal and website. This is the first such MedCOI report published by EASO.

The report starts with a general introduction to the country and the healthcare system organisation. Separate sections are dedicated to human resources in healthcare, the pharmaceutical sector, blood transfusion policies, patient pathways, insurance aspects and out-of-pocket expenditure. Lastly, separate chapters contain accessibility information on specific disease groups: cardiovascular diseases, diabetes, haematology, hepatitis, HIV/AIDS, nephrology, neurology, psychiatry, pulmonology, and finally tuberculosis.

This report was drafted by International SOS (Intl.SOS) and reviewed by experts of the following organisations: EASO, MedCOI Sector, Third Country Research Unit, Asylum Knowledge Centre; Belgian Desk on Accessibility (BDA) at the Belgian Immigration Department; Department for Asylum and Migration Policy at the International and European Affairs Unit within the Ministry of the Interior of the Czech Republic; Country of Origin Information (COI) Unit at the Ministry of Immigration and Integration within the Danish Immigration Service; and COI Information Desk / Documentation of COI documents and case law at the German Federal Office for Migration and Refugees.

The report was written according to the EASO COI Report Methodology (2019). The report is based on carefully selected sources of information. All sources used are referenced.

Från Kongo/ Ställningstagande om vissa delar av Demokratiska Republiken Kongo till sidans topp

Migrationsverket gör i det nya ställningstagandet bedömningen att det i provinserna Nordkivu, Sydkivu och Ituri pågår en inre väpnad konflikt med så urskillningslöst våld att var och en som återvänder dit riskerar att utsättas för skyddsgrundande behandling. I en rad andra provinser och regioner som räknas upp i ställningstagandet råder väpnad konflikt med varierande våldsnivå eller andra svåra motsättningar. Alla provinser är dock inte i konflikt. Det rättsliga ställningstagandet innehåller genomgångar av situationen i provinserna var för sig. Migrationsverket anser att rättsskyddet är så dåligt att det inte går att hänvisa någon till statligt myndighetsskydd. Internflykt är som huvudregel inte relevant och rimligt. Frågan om uteslutande ska beaktas i varje enskilt ärende eftersom det kan finnas asylsökande som har gjort sig skyldiga till sådana handlingar som gör att de ska uteslutas från flyktingskap eller annan skyddsstatus. Säkerhetsläget har enligt Migrationsverket inte förbättrats bestående någonstans så att det skulle motivera att neka förlängning av skyddsstatus vid förlängningsansöknignar.

Från Kongo/ As violence spikes in DRC, UNHCR concerned for trapped civilians till sidans topp

UNHCR, the UN Refugee Agency, and its humanitarian partners remain extremely concerned for the safety and security of hundreds of thousands of civilians in the Democratic Republic of the Congo's eastern Beni Territory, after deadly violence and mass protests have cut off humanitarian access to the troubled region.

Tensions in this part of DRC's North Kivu province have been rising since the launch of a government-led security operation against the Allied Democratic Forces (ADF) on October 30. Armed groups have been targeting civilians and displaced populations in the region, killing scores of people.

Growing estimates are that at least 100 people were reported to have been killed in violent attacks in the Beni region since November 2, with thousands displaced, the vast majority of them women and children. Additional mass displacements have been reported from Mbau and Oicha localities, north of Beni. People are taking refuge in the Beni town, in an attempt to flee attacks, and the ongoing fighting between the army of the DRC and ADF.

Information is difficult to verify, as the movement of humanitarian workers is restricted due to insecurity around the city and in the territory of Beni, as a result of violence. Alarming reports from the region suggest people being trapped and under threat from the armed groups, with daily reports of loss of life. Abductions and attacks on schools, health centres and indigenous communities are also on the rise.

UNHCR and its partners are calling for an urgent need to restore security to allow humanitarian agencies immediate access to support the affected population. Hundreds of households are currently sleeping in churches and schools.

Från Kongo/ FN:s kommitté mot tortyr publicerar ärenden från augustisessionen till sidans topp

Förutom de ärenden som refererats ovan har FN:s kommitté för övervakning av Konventionen mot tortyr och annan grym, omänsklig eller förnedrande behandling (CAT) publicerat ytterligare 4 ärenden som rör utvisningar från kommitténs session i juli-augusti. Två som prövades i sak rörde utvisningar till Etiopien respektive Sri Lanka. Tre ärenden lades ner på grund av att anmälningarna ansågs ogrundade. De gällde utvisningar till Kongo och Indien.

I listan över ärenden finns nu även ett par sent publicerade från vårsessionen, ett rörande en utvisning till Pakistan som prövades i sak men föll bland annat på grund av trovärdighetsbrister och ett rörande Sri Lanka som inte hade prövats i högsta instans i det nationella målet.
